2. Definitions
- Payment Instrument:
Includes credit card, debit card, bank account, prepaid payment instrument, UPI, IMPS, or any other payment method introduced by banks/financial institutions from time to time. - Platform:
Refers to the website or system where the Merchant offers products or services and where transactions can be initiated. - Transaction:
The order or request placed by the User to purchase products and/or services by paying the Transaction Amount. - Transaction Amount:
The total amount paid by the User for a Transaction. - User/Users:
Any person availing products and/or services on the Platform. - Website:
Refers to www.instamojo.com or the mobile application.
3. Merchant’s Rights
You agree that we may collect, store, and share your information to provide and fulfil the products and/or services you avail on our Platform and to contact you regarding the same.
4. Your Responsibilities
You agree to provide true, complete, and up-to-date information as required to complete Transactions.
This includes personal details such as:
- Name
- Email address
- Phone number
- Delivery address
- Age and gender
- Accurate payment information
We may ask for any other information necessary for completing the Transaction.
5. Prohibited Actions
You agree not to:
- Systematically retrieve data from the Platform without written permission.
- Make unauthorized use of the Platform, including collecting email addresses for unsolicited messages.
- Circumvent or interfere with security features.
- Trick, defraud, or mislead us or other users.
- Misuse support services or file false reports.
- Use automation tools such as bots, scripts, or data-mining tools.
- Impersonate another person or use another user’s credentials.
- Harass, abuse, or harm users or employees.
- Upload viruses, trojans, or harmful code.
- Upload excessive spam or repetitive content.
- Compete with the Platform or use it for unauthorized commercial activities.
- Reverse-engineer, decompile, or tamper with Platform software.
- Attempt to bypass access restrictions.
- Use the Platform in violation of any law.
- Disparage or harm the Platform or Merchant.
6. Limitation of Liability
If you receive a defective product or service, your only remedy is to initiate a refund process (subject to refund terms).
We expressly disclaim liability for:
- Any losses or damages
- Unauthorized use of your Payment Instrument
- Errors, malfunctions, or fraudulent transactions
You agree to indemnify and hold the Merchant and its representatives harmless against claims arising from your breach of these Terms.
7. Guidelines for Reviews
When posting reviews, you must ensure that:
- You have firsthand experience with the product/service.
- You do not use offensive, abusive, discriminatory, or hateful language.
- You do not reference illegal activity.
- You do not post false or misleading information.
- You do not post reviews if you are affiliated with a competitor.
- You do not organize campaigns for positive or negative reviews.
We may modify or remove reviews at our discretion.
Reviews do not represent our views, and we are not liable for them.
By posting a review, you grant us a worldwide, royalty-free license to use, reproduce, display, or distribute the review content.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of India.
All disputes shall fall under the exclusive jurisdiction of courts in India.
Any dispute (“Dispute”) shall be resolved through arbitration in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996.
- Parties must mutually appoint a sole arbitrator within 30 days of a notice of dispute.
- If they fail to do so, the arbitrator shall be appointed under the Act.
- Arbitration language: English
- The process shall be confidential.
- Each party shall initially bear its own costs. Final costs will be decided in the arbitral award.
Parties may still approach Bengaluru courts for injunctive relief where required.
9. Grievance Redressal
If you have any queries or complaints—including issues relating to double debit, fraud, unauthorized transactions, refund requests—you may reach out to us at our designated grievance channel.
10. Disclaimer
- By initiating a Transaction, you are entering into a binding contract to purchase listed products/services.
- You must provide accurate payment details and use legal sources of funds.
- We may share your information for fraud verification or as required by law.
- We disclaim liability for unauthorized use of your Payment Instrument.
- All payments made are at your own risk.
- We are not liable for losses caused by payment failures, declines, errors, or disruptions.
You must keep your order ID, password, or other security credentials confidential.
